Subject: PLAN FOR FINALIZAING THE CLAIMS OF CONTRACTORS.

1. Studies / discussions have been done on the claims received from various contractors involved in the construction of commercial buildings at Islamabad by Sub-Committee of the ETP Board and concerned staff. Most of the information required and relevant data is available for a conclusive action. Part of the claims have been agreed in principle, whereas balance are under discussion or not agreed. Still these decisions are to be processed through staff channels to the Chairman and may also require ETP Board's approval. For finalizing the issues, final decisions taken in this regard although discussed have to be conveyed to the concerned parties, so that they can proceed with further action. Affected parties have the option to go for arbitration.

2. To finalize the issue, fol plan is suggested:

a. Departmental committee to consider, technical, financial and legal aspects of the claims and preparing the recommendations for consideration by the Chairman may be formed. Constitution of committee is proposed as fol:-
(1) Vice Chairman
(2) Superintending Engineer
(3) Chief Controller of Accounts.
(4) Project Director / XEN, Islamabad.
(5) Director (Legal)
(6) Representative of Consultants / Specialist (whenever required).

b. The committee may also get the guidance of Sub-Committee of the Board already nominated for handling claims / adhoc payments.

c. Recommendations of Departmental Committee along with comments of ETPB Board's Sub-Committee be submitted to the Chairman for consideration. The same if required be discussed in the ETP Board's meeting and final reply to the affected firms can be sent.

3. Time Schedule: As most of the deliberations have been done by the consultant / sub-committee of the ETP Board, therefore, the recommendations in respect of following firms can be submitted to the Chairman, ETP Board within 2-3 weeks time and same can be finalized in the next ETP Board's meeting:

a. M/S ECHOWEST.
b. M/S HABIB ULLAH ASSOCIATES.
c. M/S NAQVI AND SIDDIQUIE.

4. Balance claims in respect of fol can be considered after three weeks and their processing would take another three weeks:

a. M/s ASHERS Trading and Construction Co.
b. M/s Habibullah Associates (Pvt). Limited.
c. M/s Naqvi and Siddiquie Associated.

5. The Departmental Committee with the guidance of ETP Board's Sub-Committee to also submit the recommendations for finalization of finances / works for consideration of the Chairman and approval by the ETP Board.

Language: Fluent in English, Urdu and working knowledge of Arabic.

PRESENT STATUS: Lieutenant Colonel retired from
Pakistan Army Corps of Engineers. After retirement recruited by FPSC on permanent BPS-19 post in MES. Service governed by Civil Servants Act.

Planning, evaluation and execution of maintenance and new works.c. Processing award of contracts, monitoring of works and processing of claims.d. Management of large building complexes having modern facilities like central air-conditioning, lifts, fire detection system etc. e. Budget planning and allocation of funds / resources.f. Feb 99 to Feb 2001 Worked as Officer In-Charge Logistics Section in Engineer In-Chief Branch, GHQ, Rawalpindi Responsibilities included fol:-a. Planning, processing and arranging procurement of materials required for all the wings of Military Engineering Services.b. Inspection of central stocks of all the Wings of MES.c. Evaluation and processing approval all types of new materials to be incorporated for use in MES works. The process included a detailed scrutiny of manufacturing facilities, specifications, testing as per national / international codes and performance.d. Scrutiny and evaluation of contracts.e. Processing revision of rates and fixing of ruling percentage on various schedules for estimation purposes.

June 97 to May 98 Worked as Project Engineer for the planning / development of a large Cooperative Housing Project spread over 500 Acres. The project consists of 2000 residential plots, commercial areas, schools, parks, civic facilities and their services like roads, water supply, electricity supply, gas, telephone and other facilities. Responsibilities included handling, processing and coordination of all financial, technical, administrative and legal matters related to the scheme with concerned authorities, departments and the management.

July 95 to Dec 96. Worked as Officer In-charge Works and Contracts Section for Electrical / Mechanical Services with Director of Works and Chief Engineer Pakistan Army. Responsibilities included fol:-a. Planning, evaluation and processing of Project Estimates / Contract Agreements for maintenance works pertaining to electric, water supply, air-conditioning, gas supply, POL installations and other related works of similar nature for all the cantonments in Pakistan.b. Processing award of contracts including technical scrutiny, monitoring during execution, and finalization of claims etc for the above works.c. Render technical advice to all the field executives on maintenance problems regarding electrical / mechanical services.d. Administer technical control over construction machinery pool held with the organization.e. Process procurement of construction plants, transport, generators and related equipment for the organization.

Sep 93 to Jun 95 Worked as In-charge Works and Contract Section with Director of Works and Chief Engineer Army looking after large civil engineering works for army in a large zone and responsible for:a. Technical planning / feasibility.b. Processing / finalization of designs, technical specifications etc. through various agencies.c. Preparation / processing of cost estimates.d. Processing pre-qualification of contractors.e. Processing award of contracts through various channels including technical / financial scrutiny.f. Contract monitoring after the award of contract till completion.g. Processing claims, deviations, and other negotiations during contract execution.

Feb 92 to Aug 93. Worked with FWO Task Force Kuwait as Officer Incharge Execution for Explosive Ordinance Disposal and area clearance operation. The job included planning and management of part of above operation with a team of approx 400 men and allied equipment / machinery / vehicles. It included detection, disposal and clearance of all types of explosive ordinance which included bombs, cluster bombs, live / burnt munitions land mines and other lethal devices from vast desert, built up and coastal area of Kuwait after Gulf War. After ordnance disposal, rehabilitation of affected areas was done in record time. Special commendations were awarded by US and Kuwait Army for exceptional performance.

June 90 to Feb 92 Worked with Frontier Works Organization as Officer Incharge project execution for the Civil Works of Mangla Hydro Electric Power Station Extension Project. The project included construction of power house, switch yard, loading bay, tunnel lining access road and large residential colony with complete services like roads, water supply sewerage etc. Major activities included mass concreting at various heights / depths, tunnel concreting which required pumping of concrete to approx 1700 feet in restricted area, major dewatering and large quantum of building construction. It also included sheet piling, large excavation, drilling grouting and rock stabilization. In addition to construction activities, it required management of a large work force of manpower, a large fleet of construction equipment / vehicles and a large inventory of stores. The project also included manufacture of large prestressed girders and their transportation to the construction site.

Apr 88 to May 90 Worked with Frontier Works Organization as Incharge of Planning Branch and responsible for:-a. Planning of large civil engineering projects from operation / economic point of view.b. Getting the organization pre-qualified for very large national / international projects and their submission.c. Preparation of claims and negotiations for extra works / disputed issues of contracts.d. Future planning for the organization for acquiring new works / contracts.
Aug 87 to Mar 88 Worked with Pakistan Army engineers. The responsibilities included:a. Administration, management logistics; training and employment of approximately 850 persons under normal / field conditions in a vast and logistically difficult area.b. Provision of combat engineer support e.g. water supply, access tracks / roads, landing strips, electric supply, temporary accommodations etc. to army troops in the field.c. Checking / clearance of important areas from explosives / bombs points of view for the security of VIPs.

Mar 85 to Jul 87 Worked with Frontier Works Organization as Officer Incharge project Execution of a Large Salinity Control Project Financed by Work Bank. The job included construction of large drains, ditches and their support structures like bridges, aqueducts, outfall structures, culverts etc. Project was spread over large area and all types of soils were encountered like sand, sluch, mud etc. which made the construction / logistic activities very difficult. The project also included part construction of a lined irrigation channel. Responsibilities included planning, monitoring, execution, billing, quality control and handling over completed works to the sponsors. It involved handling and employment of manpower, large fleet of vehicles and construction equipment / materials, which was successfully accomplished.

Aug 82 to Feb 85. Worked with Army Housing Directorate as Officer Incharge Works at Karachi and responsible for planning, management of following:a. A Large Housing Project Consisting of 160 Multistory Apartments, a shopping center and all the allied services like water supply, gas, electric supply, sewerage and roads etc for the complete scheme spread over 8 acres. The systems are still considered to be the best from construction, qualify and cost point of view. In addition to the planning, construction and management of project, also involved in the standardization of various construction materials used in the work to make the construction sound and economical. This aspect required detailed study of specifications, trials, market surveys and economic study for approval. After completion of project, their renting, maintenance handing over to tenants / owners and preparation of hiring documents etc. was also done and sorted out all other related details as this was the first largest project of Army Housing Directorate at Karachi.b. Planning a housing scheme for 100 houses in Malir and construction of 10 houses of Army Housing Directorate. c. Civil work for a Large Sugar Mills Complex of 2000-3000 tonnes crushing capacity at Badin. The project included construction of main mills house, power house, process house evaporation ponds, large housing colony and administration buildings etc. Lot of coordination was required for smooth execution of concurrent electrical / mechanical works. The project also included a large network of electric, sewerage, water supply and roads. The project was successfully completed in record time and the mill complex was handed over to the user fully functional.

Jan 81 to Jul 82 a. Worked as Staff Officer of an Engineer Group and Responsible for planning, monitoring, execution and operation of large civil engineering projects like runways, jetties, underground construction, roads etc.b. Worked as Project Manager of a project consisting of 4 Berths and two very large transit sheds including their allied facilities for Karachi Port Trust under the consultancy of Professor Dr. Lackner & partners of West Germany. The job included planning supervision and coordination of complete project activities. Duties also included management of staff / labour/ equipment, preparation of bills / claims negotiation with consultants / sub-contractors and other project related activities.

Aug 76 to Dec 79 Worked in Pakistan Army Corps of Engineers as Commander of Bridging Sub Unit, responsible for provision of combat bridging equipment for operational requirements including its storage, maintenance and operational worthiness. The job also included employment of various types of expedients in all types of terrain. Various other activities included management of large fleet of transport, engineering equipment and other stores including training of personnel at all levels.

Apr 73 to Aug 76 Worked in an Engineer Unit of Pakistan Army Corps of Engineers of construction of roads / structures and support tasks for oil exploration project including surveys. Projects included extensive use of heavy engineering equipment. Construction was spread in sandy, mountainous and plain areas. It also required extensive logistic support and special management being in remote area.Worked in Pakistan Army Corps of Engineers Operational Combat Unit for operational and training jobs of combat engineer operations in desert areas including all combat related construction works. Also worked as Staff Officer.

Nov 69 to Mar 73 Worked in an Operational Engineer Unit of Pakistan Army and responsible for all operational tasks including an experience of War for extensive mine fields, demolitions and other combat related engineering jobs in actual operations.
